Section 8 Rent Increase: 60-Day PHA Notice
A Section 8 rent increase goes to the housing authority, in writing, 60 days ahead; a tenant notice alone does not count. Plus the inspection cure clocks.
On a Housing Choice Voucher unit, the rent increase that counts is the one the housing authority receives — in writing, at least 60 days before it takes effect. The tenant's copy is not enough.
Landlords who rent to voucher tenants have two payers for one rent: the housing authority (PHA) pays its housing assistance payment (HAP) and the tenant pays the rest. That split changes how a rent increase works. Below is what the HUD form and the regulation say, with the citations, and the inspection clocks that run beside them.
Not legal advice. Your HAP contract and your housing authority's administrative plan govern; confirm with the PHA before you act.
The rule: written notice to the PHA, 60 days ahead
The HAP contract is HUD form 52641. Its tenancy addendum and terms set three things for a change in the rent to owner:
- Notice to the PHA at least 60 days before the change takes effect. Form HUD-52641 (4/2023), Part C ¶ 18(d).
- In writing. Any owner notice under the contract must be written (Part B ¶ 16).
- Within the reasonable rent. The rent after the change may not exceed the reasonable rent as most recently redetermined by the PHA, and the PHA must redetermine reasonable rent before any increase — 24 CFR 982.507(a)(2)(i).
A notice to the tenant alone does not count. The PHA is the party the contract names; until it has your written notice and has run its rent-reasonableness check, the new rent is not the contract rent.
What to put in the packet
The form sets the deadline, not the format. In practice a packet that a housing authority can process without a back-and-forth carries:
- a cover letter naming the unit, the tenant, the HAP contract number and the effective date;
- the current contract rent and the proposed rent;
- comparable units for the rent-reasonableness review (the PHA makes the call; your comparables help it);
- a copy of what you are sending the tenant, if your lease and state law require a tenant notice too.
Count the 60 days back from the effective date and send early: the PHA has to redetermine reasonable rent before the increase, and its timetable is not yours.
The clocks beside it: inspections
Rent increases are not the only HUD deadline on a voucher unit. When an inspection finds deficiencies, 24 CFR 982.404 sets the clock:
| Deficiency | Cure period |
|---|---|
| Life-threatening | 24 hours from notification |
| Any other | 30 calendar days, or a reasonable extension the PHA approves |
If a deficiency is not cured, the PHA must abate the HAP. If the unit still fails 60 days after the notice of abatement (or a longer reasonable period the PHA sets), the PHA must terminate the HAP contract. That 60-day rule applies to HAP contracts executed on or after, or renewed after, June 6, 2024; older contracts follow § 982.404 as it stood on that date (§ 982.404(f)).
During an abatement the tenant does not owe the withheld HAP — it is not theirs to pay.
Where Proprietio fits
Section 8 landlord software — Proprietio's Voucher Desk — keeps both clocks next to the lease: the rent increase packet with your comparables and a reminder before the 60-day deadline, and every deficiency with its 24-hour or 30-day cure clock, the abatement days and the amount withheld. Each month's rent shows the tenant portion and the HAP side by side, and the tenant portal collects only the tenant's share.
